Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Command Center website, applications, analytics tools, and related services collectively referred to as the "Services."

The Services are provided by Command Center LLC ("Command Center," "we," "us," or "our").

By creating an account, connecting a third-party account, or otherwise accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, you must not access or use the Services.

1. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services.

If you use the Services on behalf of a company, shop, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" also refers to that entity.

The Services are intended primarily for business users, including TikTok Shop owners, sellers, managers, and their authorized representatives.

2. Description of the Services

Command Center provides analytics, reporting, inventory, sales, revenue, product-performance, and related business tools for online shop owners.

The specific features available to you may depend on:

  • Your account type
  • Your subscription or service plan
  • The third-party accounts you connect
  • Permissions granted by you
  • Third-party API availability
  • Geographic or platform restrictions

We may add, modify, suspend, or discontinue features at any time.

3. Account Registration

You may be required to create a Command Center account to use certain features.

You agree to:

  • Provide accurate and current account information
  • Keep your login credentials confidential
  • Use reasonable measures to protect your account
  • Promptly notify us if you suspect unauthorized access
  • Accept responsibility for activity conducted through your account

You may not share your account in a way that allows unauthorized individuals to access the Services or data belonging to another person or business.

We are not responsible for losses caused by your failure to adequately protect your account credentials.

4. Connecting TikTok Shop and Other Accounts

Certain features require you to connect a TikTok Shop or another third-party account.

By connecting an account, you represent that:

  • You own the account or have permission from the owner to connect it
  • You are authorized to access the information made available through that account
  • Your use of the connected account complies with applicable laws and platform rules
  • You authorize Command Center to access and process the permitted information to provide the Services

You are responsible for reviewing and selecting the permissions you grant.

You may revoke Command Center's access through the applicable third-party platform or through available Command Center account settings.

5. TikTok Shop Data

When you authorize access to a TikTok Shop account, Command Center may process information made available through authorized TikTok Shop APIs, including:

  • Shop and seller information
  • Product and SKU information
  • Inventory information
  • Order and sales information
  • Revenue and transaction-related information
  • Fulfillment and performance information
  • Other information needed to provide requested analytics

Command Center will only use TikTok Shop data as described in our Privacy Policy, as authorized by you, and as reasonably necessary to provide and protect the Services.

You retain any ownership rights you have in your shop information and business data.

Command Center is an independent service provider. Command Center is not TikTok, and it is not owned, operated, sponsored, approved, or endorsed by TikTok unless expressly stated otherwise.

"TikTok" and related names, logos, and trademarks belong to their respective owners.

6. Your Responsibilities

You are responsible for:

  • Ensuring you have permission to provide or connect all information used with the Services
  • Complying with laws applicable to your business
  • Maintaining accurate product, order, inventory, accounting, and tax records
  • Reviewing analytics before relying on them
  • Confirming important information through the original platform or official business records
  • Maintaining any licenses, registrations, tax accounts, or permits required for your business

Command Center does not operate your TikTok Shop and is not responsible for your shop's products, customers, orders, returns, taxes, fulfillment, advertising, or regulatory compliance.

7. Acceptable Use

You may only use the Services for lawful and authorized business purposes.

You may not:

  • Access another user's account or data without authorization
  • Provide false or misleading registration information
  • Use the Services for fraud, deception, or unlawful activity
  • Attempt to bypass authentication, permissions, or security controls
  • Copy, scrape, harvest, or extract data through unauthorized methods
  • Reverse engineer, decompile, or attempt to discover the source code of the Services, except where such restrictions are prohibited by law
  • Use automated systems that place an unreasonable burden on the Services
  • Introduce malware, viruses, malicious code, or harmful materials
  • Interfere with the availability, security, or operation of the Services
  • Use the Services to violate TikTok's terms, policies, or applicable platform requirements
  • Resell, sublicense, or commercially exploit the Services without written authorization
  • Use data obtained through the Services for unauthorized advertising, surveillance, profiling, or marketing
  • Attempt to identify individuals from aggregated or anonymized information

We may investigate suspected violations and suspend or terminate access when reasonably necessary to protect users, third parties, or the Services.

8. Analytics and Data Accuracy

The Services may display analytics, estimates, calculations, summaries, projections, trends, or other information derived from third-party data.

Analytics may be incomplete, delayed, duplicated, unavailable, or inaccurate because of:

  • Third-party API delays or outages
  • Changes to third-party systems
  • Incorrect information supplied by users
  • Missing permissions
  • Data-processing errors
  • Returns, cancellations, disputes, taxes, fees, discounts, or adjustments
  • Differences between estimated and finalized transactions

You are responsible for independently verifying information before making financial, inventory, tax, legal, employment, or business decisions.

Command Center does not guarantee that analytics will match statements, reports, or records produced by TikTok Shop, a financial institution, payment processor, accountant, or government authority.

9. No Professional Advice

The Services provide informational and analytical tools only.

Nothing provided through the Services constitutes:

  • Legal advice
  • Tax advice
  • Accounting advice
  • Financial or investment advice
  • Employment advice
  • Regulatory or compliance advice

You should consult an appropriately qualified professional before making decisions requiring professional advice.

10. Third-Party Services

The Services may depend on or integrate with third-party platforms, APIs, hosting providers, authentication providers, databases, and other service providers.

Your use of third-party services may be governed by separate terms and privacy policies.

We do not control and are not responsible for:

  • Third-party platform availability
  • API limits or restrictions
  • Changes to third-party features
  • Third-party account suspensions
  • Third-party data accuracy
  • Third-party security incidents
  • Actions taken by TikTok or another platform
  • Loss of access caused by a third-party decision

A third-party platform may change, restrict, suspend, or discontinue access to its services or APIs. Such changes may prevent some or all Command Center features from operating.

11. Fees and Paid Services

Some Services may be offered for a fee.

Prices, billing periods, included features, and applicable taxes will be presented before you purchase a paid plan.

By purchasing a paid Service, you authorize us and our payment provider to charge the payment method you provide for the disclosed fees and taxes.

Unless otherwise stated at checkout:

  • Subscription fees are charged in advance
  • Subscriptions automatically renew for the same billing period
  • You may cancel future renewals through your account or by contacting us
  • Cancellation prevents charges for future billing periods

We may change prices or subscription features. When reasonably required, we will provide notice before a pricing change applies to your next renewal.

You remain responsible for charges incurred before cancellation.

12. Intellectual Property

The Services, including their software, designs, interfaces, reports, dashboards, branding, documentation, and underlying technology, are owned by Command Center or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, Command Center grants you a limited, nonexclusive, nontransferable, revocable license to access and use the Services for your internal business purposes.

This license does not allow you to:

  • Copy or distribute the Services
  • Sell or sublicense access
  • Create a competing product using protected portions of the Services
  • Remove copyright, trademark, or proprietary notices
  • Use Command Center branding without written permission

No ownership rights are transferred to you under these Terms.

13. Your Content and Business Data

You retain ownership of information, files, business records, and other content that you submit to the Services.

You grant Command Center a limited license to host, process, transmit, reproduce, and display your content only as reasonably necessary to:

  • Provide the Services
  • Generate requested analytics
  • Maintain and secure the Services
  • Troubleshoot technical issues
  • Comply with legal obligations
  • Enforce these Terms

You represent that you have the rights and permissions necessary to provide your content to Command Center.

14. Feedback

You may provide suggestions, comments, ideas, or other feedback about the Services.

You grant Command Center permission to use feedback without restriction or compensation, provided that we do not publicly identify you as the source without permission.

15. Privacy

Our collection and use of personal information are described in our Privacy Policy:

The Privacy Policy is incorporated into these Terms by reference.

16. Service Availability

We work to keep the Services available and functional, but we do not guarantee uninterrupted or error-free access.

The Services may be unavailable because of:

  • Maintenance
  • Software updates
  • Security issues
  • Internet or hosting failures
  • Third-party API interruptions
  • Events outside our reasonable control

We may impose reasonable usage limits to maintain security, performance, and availability.

17. Suspension and Termination

You may stop using the Services at any time.

You may request account closure by contacting:

We may suspend or terminate your access if:

  • You violate these Terms
  • Your use creates a security or legal risk
  • Your payment is overdue
  • A connected third-party platform requires suspension
  • We are required to do so by law
  • We discontinue the Services
  • Your account has been inactive for an extended period
  • Your use threatens the stability or integrity of the Services

Where reasonable, we may provide notice and an opportunity to correct the issue before termination.

We may act immediately when necessary to address fraud, abuse, security threats, legal obligations, or serious violations.

Upon termination, your right to use the Services ends.

Sections that by their nature should survive termination will remain effective, including provisions addressing ownership, disclaimers, liability, indemnification, and dispute resolution.

18. Data After Termination

After account closure, disconnection, or termination, we may delete or anonymize account information and connected shop data in accordance with our Privacy Policy and applicable legal requirements.

You are responsible for exporting any information you wish to retain before closing your account.

We do not guarantee that data will remain available after termination.

19. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis.

Command Center disclaims all warranties, express or implied, including warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Noninfringement
  • Accuracy
  • Availability
  • Reliability
  • Security
  • Compatibility

We do not warrant that:

  • The Services will always be available
  • Analytics will be complete or accurate
  • Errors will be corrected immediately
  • The Services will meet every business requirement
  • Third-party integrations will continue to operate
  • Use of the Services will increase sales, revenue, profit, or business performance

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

20. Limitation of Liability

To the maximum extent permitted by law, Command Center and its owners, members, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages.

This includes damages arising from:

  • Lost revenue or profits
  • Lost business opportunities
  • Lost or corrupted data
  • Inventory errors
  • Incorrect analytics
  • Business interruption
  • Third-party platform actions
  • Unauthorized account access
  • Reliance on information provided by the Services

To the maximum extent permitted by law, Command Center's total liability arising out of or relating to the Services or these Terms will not exceed the greater of:

  1. The total amount you paid to Command Center during the three months immediately preceding the event giving rise to the claim; or
  2. One hundred U.S. dollars.

These limitations apply regardless of the legal theory on which a claim is based.

Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.

21. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Command Center LLC and its owners, members, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, penalties, and reasonable legal expenses arising from:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of applicable law
  • Your products, shop, orders, advertising, or business activities
  • Your violation of a third party's rights
  • Content or information you submit
  • Your unauthorized access to or use of another person's account or data

We reserve the right to control the defense of a matter subject to indemnification. You agree to reasonably cooperate with that defense.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Any legal action arising from these Terms or the Services must be brought in a state or federal court located in Maricopa County, Arizona, unless applicable law requires otherwise.

You consent to the personal jurisdiction and venue of those courts.

23. Changes to These Terms

We may update these Terms to reflect changes to:

  • The Services
  • Our business practices
  • Applicable laws
  • Third-party platform requirements
  • Security or operational needs

When we update these Terms, we will revise the Effective Date at the top of this page.

For material changes, we may provide additional notice through the Services, by email, or through another reasonable method.

Your continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms.

24. Electronic Communications

By using the Services or contacting us electronically, you consent to receive electronic communications related to:

  • Your account
  • Security
  • Transactions
  • Service updates
  • Legal notices
  • Changes to these Terms

You agree that electronic notices satisfy legal requirements that communications be provided in writing, where permitted by law.

25. Assignment

You may not transfer or assign your rights or obligations under these Terms without our written permission.

Command Center may assign these Terms in connection with a merger, acquisition, financing, corporate restructuring, sale of assets, or transfer of the Services.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.

27. Waiver

A failure by Command Center to enforce a provision of these Terms does not waive our right to enforce that provision later.

28. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented for a specific Service, form the entire agreement between you and Command Center concerning the Services.

They replace prior discussions, representations, or agreements concerning the same subject matter.
